We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In no case shall Datainsights, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend and hold harmless Datainsights and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.


SECTION 15 – SEVERABILITY

 

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.


SECTION 16 – TERMINATION

 

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).


SECTION 17 – ENTIRE AGREEMENT

 

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.



SECTION 18 – Document Preparation [Writing assistance including Plagiarism check, Plagiarism removal, Document formatting, Proofreading, Citation formatting, etc. and Publication assistance]


Writing assistance- The client has to share novel and unique data for which we provide writing assistance. The client is advised to check the delivered work thoroughly before submission. We will provide one-time modification of the draft/work free-of-charge. Minimum 30 days are required for the modifications to be incorporated in the draft copy. Additional modifications will be charged at a reasonable price. The client must provide requirements in writing or approve requirements provided by our team in writing. We have previously delivered work within the specified timeframe. However, in case of unavailability of resources at our end, we can stop the assistance work anytime. We will not be responsible for the academic loss caused due to ‘no delivery’ and ‘late delivery’ of the assistance work. Writing assistance will be provided for 365 days from date of advance payment. The work will start when advance payment is received by us, i.e., 50% of Grand Total. The work will be delivered when delivery payment is received by us, i.e., 50% of Grand Total. Plagiarism percentage of the file will be maintained at 20. Extra charges should be paid if the plagiarism percentage is to be maintained below 20.

Publication assistance- Publication assistance will be provided for 12 journal submissions or 365 days from date of Quotation on subscription basis, whichever is earlier. We don't have tie-up with any journal directly or indirectly. The client is advised to check the delivered work thoroughly before submission. Thus, we don't take responsibility for the publication of any paper. You are advised to make suitable improvements in the draft/work/paper as per your expertise. The work will start when advance payment is received by us, i.e., 50% of Grand Total. Paper will be submitted within 30 days of advance payment and after approval from the client. We can manage the submission process of a maximum of two journals at a time. Remaining payment should be paid after acceptance of paper. After 365 days of advance payment, subscription for Publication assistance should be renewed. We are not affiliated, associated, authorized, endorsed by, or in any way officially connected to any journal.

SECTION 19 – JOURNAL FINDER


Five journals will be suggested using our journal finder software and expert's suggestion. The clients are advised to check details of the journal before submission of the paper as Journal office updates them regularly.



SECTION 20 – SOFTWARE SERVICES


The client has to share novel and unique data for which we provide assistance. We will provide One-time modification of the draft free-of-charge. The client must provide requirements in writing or approve requirements provided by our team in writing. We have previously delivered work within the specified timeframe. However, in case of unavailability of resources at our end, we can stop the assistance work anytime. In that case, we will refund the advance payment if paid. We will not be responsible for the academic loss caused due to ‘no delivery’ and ‘late delivery’ of the assistance work.



SECTION 21 – GOVERNING LAW

 

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of India and jurisdiction of Maharashtra. It is considered that the client agrees to all the terms and conditions mentioned above after we receive the advance payment of the Package purchased.

Frequently Asked Questions

Ans. Our charges are merely compensation for the hours spent in providing the service. Also, the publication of paper depends largely on the quality of your research and is a subjective decision that the journal editor takes based on several factors. The acceptance rate of journals varies from 10% to 90%. Therefore, we cannot guarantee publication. However, by helping you understand and follow publication protocols and by offering Editing and Submission, we help you increase your chances of publication. 


Ans. Different journals have different policies and operate on different revenue models. Hence, they have different fee structures as well. For example, most subscription-based journals charge authors for printing color figures/artwork. However, they do not charge any fees for publishing a manuscript. On the other hand, many open-access journals charge authors a fee for publishing their articles and they use these fees to maintain the journal. As these fees differ from journal to journal and, more importantly, need to be paid by the authors themselves, they are not included in our Journal Submission fee. 


Ans. With our publication assistance, you can consult experts for guidance at all stages of the publication process. Our expert panelists will review your paper and provide constructive comments so that you can improve your manuscript before submission to the journal of your choice. The experts will work with you to determine the most suitable journals, assist in manuscript editing before submission, carry out a technical review, and provide post-submission support wherever necessary. Ans. The acceptance of a paper is solely up to the discretion of the journal. Depending on the service you choose, our experts could guide you to help you publish the manuscript and also advise you on how to avoid rejection. However, a refund will not be provided as the expert has already worked on your projects.

Ans. We will need your complete manuscript (from the title page to references including figures and tables) to carry out any of these publishing services. For Journal Selection, it would help if you could also share your preferred impact factor, indexing, and any previous rejection history.


Ans. The publication assistance pack is valid for 12 journal submissions or 365 days from the date of quotation whichever is earlier. At the end of 365 days, the Publication Assistance Package should be renewed by the client by paying its advance fee.
